This Privacy Policy describes how LUMYER INC ("LUMYER INC", "Lumyer Inc.", "We", "Us", or "Our") protects your privacy when you use Lumyer (the "Service") which includes the Web site located at www.lumyer.com (the "Site") and all Lumyer mobile phone applications ("Mobile").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS AND CONDITIONS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW, YOU MAY NOT USE THE SERVICE.

This Privacy Policy applies to information (including, personal information) collected through the Service. The What & How of Information We Collect

Personal information may be collected in a number of ways. We may collect certain information that you voluntarily provide to us which may contain personal information. For example, we may collect your name, email address, user name, social network information and other information you provide us when you register, set up an account, contact us by e-mail or use our services. We may also obtain information from other companies and combine that with information we collect on the Service. When you visit the Site, some information may be automatically collected. Web Beacons - Web beacons, also known as gifs, are electronic images that may be used on the Site or in our emails. A Web beacon may be used on our Web pages to collect information, deliver cookies, count visits, compile statistics on usage and campaign effectiveness and in our emails to tell if an email has been opened and acted upon.

Metadata - Users can add or may have Metadata added to their User Content including a hashtag (e.g., to mark keywords when you post a photo), geotag (e.g., to mark your location to a photo), comments or other data. This makes your User Content more searchable by others and more interactive. If you geotag your photo or tag your photo using other's APIs then, your latitude and longitude will be stored with the photo and searchable (e.g., through a location or map feature) if your photo is made public by you in accordance with your privacy settings.

Storage of Information & Transfer of Data

Most of the information we collect are not retained on our servers. If you are using the Service from a country other than the country in which our Web servers providers are located the various communications will necessarily result in the transfer of information across international boundaries. By visiting the Site and communicating electronically with us, you consent to the processing and transfer of your data as set out in this Privacy Policy.

You may "opt-out" of receiving promotional communications including, but not limited to, promotional emails, from us by emailing us at privacy@lumyer.com. Transactional service communications including, but not limited to, messages about your registration, will not be subject to the foregoing opt-out procedures. Requests to 'Remove Account' or 'Reset Password' should be sent to privacy@lumyer.com for faster processing.

SECURITY OF YOUR PERSONAL INFORMATION

We take reasonable security measures to protect your personal information (including, preventing the loss, misuse, unauthorized access, disclosure, alteration and destruction of your personal information). Please be aware, however, that despite our efforts, no security measures are impenetrable. If you use a password on the Service, you are responsible for keeping it confidential. Do not share it with any other person. If you believe your password has been misused, please advise us immediately.

MINORS

THIS SERVICE IS NOT MEANT FOR MINORS. We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Service is not intended for and may not be used by children under the age of 13. We do not knowingly collect information from children under the age of 13 and we do not target the Service to children under 13.

Facebook Users

according to articles 13 and 14 of the Regulation (EU) 2016/679 (“GDPR”) General Data Protection Regulation

The personal data (“Data”) of the data subject are processed by Us “Lumyer Inc.”, as Data Controller, in compliance with the principles of protection of personal data established by EU Regulation 2016/679 ("GDPR").

METHODS AND PURPOSES OF DATA PROCESSING

The Data subject’s information is processed for the following purposes:

  1. Interaction with users;
  2. Management of the Facebook page;
  3. Facebook advertising campaigns;
  4. Analysis of the statistics in the "Insights" section.

LAWFULNESS OF PROCESSING

The legal basis of the processing related to the replies to users' requests is the necessity “to take steps at the request of the data subject prior to entering into a contract” according to art. 6(1) (b) GDPR. Concerning the processing of the user’s Facebook profile Data (name and profile image) and the statistical Data generated as a result of user interaction with the page, the Data will be processed by the Data Controller jointly with the company Facebook Ireland Ltd. ("Facebook").

CATEGORIES OF RECIPIENTS

The Data will be processed, insofar as it is necessary, by authorized personnel, adequately trained by the Data Controller and by third parties who provide services to the Data Controller and process data as Data Processor (according to the instructions of the Data Controller).

DATA RETENTION PERIOD

Our company has adopted the following data retention policy:

  1. We will store the messages with legal and commercial relevance for 10 years.
  2. We will store the other messages for 24 months.

DATA TRANSFER

Facebook may transfer the users’ Data to countries outside the EEA (European Economic Area). The data transfer complies with the GDPR since Facebook has adhered to the Privacy Shield Framework:

RIGHTS OF THE DATA SUBJECT

The Data Subject may exercise the rights granted by the GDPR (articles 15-22), including:

a. The right to receive confirmation as to whether the Data Controller is processing the Data Subject’s personal data (access rights);
b. The right to update, modify and / or correct personal data (right of rectification);
c. The right to request the erasure of data or the restriction of the processing. This right can be granted if the process is unlawful or the controller no longer needs the personal data for the purposes of the processing (right to be forgotten and right to restriction of processing);
d. The right to oppose to the processing (right of opposition);
e. The right to propose a complaint to the Supervisory Authority in case of violation of the regulations regarding the protection of personal data;
f. The right to receive an electronic copy of the Data Subject’s personal data (in a structured, commonly used and machine-readable format) and right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided (right to data portability).
